Dzisiaj troche o moich kolejnych doswiadczeniach imigracyjnych... Po zawarciu zwiazku malzenskiego z obywatelem USA otrzymalam Zielona Karte. Cala historie tego procesu znajdziecie tutaj. Chociaz my nie mielismy i nie mamy nic do ukrycia, nie zawarlismy malzenstwa z powodu jakichkolwiek korzysci imigracyjnych to mi sie ten proces wcale nie podobal, poniewaz jest bardzo dlugi, czasami bywa skomplikowany, trzeba jezdzic na oddawanie odciskow palcow, wywiady itp, itd. Niestety jak chce sie miec zalegalizowany pobyt to czy sie to komus podoba czy nie musi przez to przejsc... Kiedy ubiegalam sie o Zielona Karte bylismy malzenstwem z kilku miesiecznym stazem dlatego otrzymalam Zielona Karte tylko na dwa lata, jest to tak zwana Warunkowa Karta Stalego Pobytu co oznacza, ze po dwoch latach jesli malzenstwo przetrwa probe czasu mozna aplikowac o zdjecie warunku i otrzymanie Zielonej Karty na 10 lat, jesli malzenstwo nie przetrwa to nie dostaje sie zadnych profitow i trzeba sie zwijac z USA no chyba, ze ktos woli pozostac tutaj nielegalnie albo szukac innych rozwiazan zalegalizowania pobytu. 13 listopada 2017 roku mina dwa lata odkad jestem w posiadaniu tej magicznej karty, ale juz trzy miesiace przed uplywem tego terminu moglam aplikowac o zdjecie warunku. W moim przypadku moglam wyslac wszystkie papiery do Urzedu Imigracyjnego w polowie sierpnia, ale w ogole o tym zapomnialam i zrobilam to dopiero na poczatku wrzesnia (roznica nie duza).
Zdjecie warunku z Zielonej Karty krok po kroku...
1. Nalezy wypelinic forme I-751, ktora mozna pobrac z tej strony. Musicie byc bardzo uwazni, nie mozna tam niczego przegapic, forma musi byc wypelniona czarnym dlugopisem albo na komputerze. Od razu zaznaczam, ze forme musza podpisac maz i zona! My zupelnie zle odczytalismy sformulowania na formie i odeslano nam caly komplet dokumentow, poniewaz tylko ja sie tam podpisalam, a moj maz nie. Wlasnie dzisiaj uzupelnilismy forme o podpis mojego meza i znowu przesylka priorytetowa odeslalam caly komplet dokumentow do USCIS w Kalifornii, gdzie Minnesota ma swoj oddzial. Nie pytaja w tej formie o zadne niestworzone rzeczy, sa to podstawowe informacje, ale tak jak wspomnialam wyzej trzeba wszystko przesledzic krok po kroku, zeby czegos nie pominac, bo oni sie nie przejmuja tylko od razu odsylaja wszystko.
2. Do formy I-751 nalezy dolaczyc dowody potwierdzajace, ze caly czas pozostajecie w zwiazku malzenskim. Jesli dowody sa satysfakcjonujace to moze Was ominac kolejny wywiad w Urzedzie Imigracyjnym. My dolaczylismy nastepujace dokumenty: wspolne rozliczenia podatkowe, ubezpieczenie na zycie, ubezpieczenie zdrowotne, ubezpieczenie samochodu, akt wlasnosci domu, informacje kredytowe, akt wlasnosci samochodow, testament, umowy wynajmu, informacje bankowe, ponad 100 wspolnych zdjec i jeszcze kilka innych dokumentow, ktore maja w tresci dane nas obojga. Im wiecej dokumentow tym lepiej, poniewaz sa to sztywne dowody na to ze rzeczywisice malzenstwo nie jest fikcja. Nie powinno to byc trudne zadanie, aby znalezc takie dokumenty, tylko strasznie duzo skanowania i drukowania akurat w naszym przypadku bylo:) Ja rowniez napisalam krotki list przewodni, w ktorym krotko objasnilam historie naszego malzenstwa, podkreslajac, ze jestesmy malzenstwem z milosci i wymienilam liste dowodow na to, ktore dolaczam do listu. Obydwoje podpisalismy sie pod tym listem.
3. Nalezy oczywiscie uiscic oplate, nigdzie nie ma nic za darmo, a juz na pewno nie w Ameryce! Pieniadze mozna wyslac czekiem, albo money gramem, ja skorzystalam z tego drugiego. Oplata za forme I-751 to $595 + $85 za odciski palcow. W sumie koszt zniesienia warunku z Zielonej Karty to $680.
Tak jak wspomnialam wyzej ja dzis wyslalam poprawiona forme ze wszystkimi dokumentami do Kalifornii. Oddzial do ktorego nalezy wyslac dokumenty zalezy od tego w jakim stanie mieszkacie, informacje gdzie wyslac papiery znajdziecie rowniez na tej stronie. Tam tez znajdziecie instrukcje do wypelnienia formy i informacje o oplatach, Generalnie jak juz macie Zielona Karte i pozostajecie dalej w zwiazku malzenskim to zniesienie tego warunku to zwykla formalnosc. Trzeba tylko dobrze wypelnic forme, podpisac sie tam gdzie trzeba i dolaczyc zelazne dowody, ale kto bral slub z milosci to nie ma z tym problemu. Jesli dokumenty zostana zaakceptowane to USCIS wysyla list, ktory otrzymuja sie po tygodniu z informacja o przedluzeniu Zielonej Karty na kolejny rok, dostaniecie rowniez wezwanie do miejscowego Urzedu Imigracyjnego na oddanie odciskow palcow i wykonanie fotografii. Znajac ruchy USCIS to dostaniecie Zielona Karte na 10 lat zaraz przed mozliwym terminem ubiegania sie o obywatelstwo USA:) Mi w rozwiazaniu mojego problemu z podpisem pomogla przedstawicielka biura kongresmena Petersona z Minnesoty, ktora bezposrednio skontakotwala sie z oficerem USCIS w Kalifornii, gdzie powiedziano jej, zeby mi przekazala, ze jak bede musiala czekac na Zielona Karte na 10 lat rok to zebym sie nie zdzwila, bo chwilowo sa zajeci innymi typami wiz:) No to akurat jak dobrze pojdzie to za rok w sierpniu moge skladac wniosek o obywatelstwo...:) Zeby zostac obywatelem USA nalezy posiadac Zielona Karte przez 5 lat albo przez 3 jesli pozostaje sie w zwiazku malzenskim z obywatelem USA.
Jesli planujecie podroz poza granice USA w czasie oczekiwania na Zielona Karte na 10 lat to musicie miec przy sobie stary dokument z listem informujacym o przedluzeniu Zielonej Karty na kolejny rok, ktory otrzymacie z USCIS. Nie jestem pewna co do stempla w paszporcie, bo cos mi sie "obilo" o uszy, ale nic na ten temat nie wiem dokladniej...
I na koniec taka ciekawostka... Wspomnialam, ze ostatnio przedstawicielka kongresmena Peteresona pomogla mi w rozwiazaniu mojego problemu z forma I-751... Zupelnie przez przypadek dowiedzialam sie, ze Minnesota ma kilka dystryktow miedzy innymi jeden znajduje sie tutaj gdzie mieszkam gdzie reprezntanci kongresmena pomagaja obywatelom w rozwiazywaniu roznych spraw urzedowych i jest to zupelnie za darmo. Nie trzeba wydawac pieniedzy na adwokatow, czy innych doradcow, tylko takie osoby jak ta Pani ktora mi ostatnio pomogla maja wiedze i przede wszystkim bezposrednie kontakty z wieloma roznymi osobami z waznych, rzadowych instytucji i sa w stanie do pewnych rzeczy dojsc szybciej niz np. my zwykli obywatele, ktorzy nic konkretnego z infolinii USCIS nie sa w stanie sie dowiedziec... Sprawdzcie koniecznie czy macie takie opcje w stanach gdzie mieszkacie!

Today a little bit about my new immigration experiences... I got a Green Card after I married a US citizen. Here you can find all the information about this process. We never had anything to hide or keep it secret, we did not get married for any immigration benefits, but still I did not like the whole process of getting a Green Card. It was long, sometimes complicated, I had to give them my fingerprints, we had to go through interview and bunch of other stuff. Unfortunately if you want legalize your stay here you have to go through all of these... We were married just for several months when I was applying for a Green Card, that's why I received it only for two years, it is called Conditional Permanent Residency Card. It means that if you will survive the test of time which are two years you can apply to remove Green Card Condition and you will get 10 years Green Card. If your marriage will not make it you can start packing and leaving United States unless you will find another way to legalize your stay here. My Green Card will expire November 13th, but I already could apply for Green Card Condition Removal three months earlier, in my case it was a middle of August, but I totally forgot about it and I did it at the beginning of September (not a big difference).
Green Card Condition Removal step by step...
1. You need to file out form I-751 which you can find here. You need to be very careful. You can't miss there anything and you should fill this out with black ink or type it. The form need to be signed by wife and husband! We did interpreted this form wrong and they sent us back the whole package of documents because I only signed the form, my husband didn't. We just sent the fulfilled form with my husband's signature to USCIS in California where Minnesota has a district. They don't ask any ridiculous things in this form, just basic stuff, but as I mentioned before you need to be careful and analyze everything step by step because USCIS is not going to care, they will just send everything back.
2. You need to attach to your form I-751 evidences that you are still married. If your evidences will be sufficient they might waive additional interview. We attached these documents: jointly filled tax returns, life insurance, health insurance, car insurance, house deed, mortgage paperwork, car titles, testament, lease agreements, bank account information, more than 100 pictures of us and other documents that have both of our names on. The more the better because those are strong evidences that your marriage is real. It should not be a problem to collect these documents, but it is a lot of coping and printing:) I also attached a short cover letter where I explained our marriage story. I emphasized that our marriage is from love and I listed all evidences that I attached to the letter to prove reality of our relationship. We both signed this letter.
3. Of course you need to pay some fee, everything costs money especially in America! You can send a check or money gram. The cost of I-751 is $595 and you also need to pay $85 for biometric service. All together $680 to remove condition from your Green Card.
As I mentioned earlier I just sent my corrected paperwork to California today. A place where you need to send the paperwork you can find on this website. It depends where you live in the US. You can also find on this website instruction how to fill out forms and information about fees. Generally if you already have a Green Card and you are still married a Green Card Condition Removal is just a formal action that you need to take. You just need to correctly fill out the form, sign it where it need to be signed and attach strong evidences that your marriage is real, but if you are in loving marriage it shouldn't be any issue. If USCIS will accept you documents they will send you a letter usually in a week saying that they extend your visa for another year. You will also receive a letter with scheduled date for your biometric service. As far as I know USCIS you will receive your 10 years Green Card right before time when you will be able to apply for US citizenship... I had a problem with wrong signing of my form and I received help from representative of Congressman Peterson from Minnesota. She directly contacted USCIS in California and she talked to the officer there who told her to tell me that I shouldn't be surprised if I will be waiting a year for my 10 years Green Card because currently they are busy with different types of visas:) If everything will go well for me I will be able to apply for US citizenship August next year...:) You need to hold a Green Card for five years to become a US citizen unless you are married to US citizen then you wait just three years.
If you plan to travel outside of the United States while waiting for ten years Green Card you need to have with you an old document and the letter that your Green Card got extended for another year which you will receive from USCIS. I am not sure about the stamp in the passport... I heard something about it, but I do not have any detailed information...
And at the end I have for you a curiosity... I mentioned above that a representative of Congressman Peterson from Minnesota helped me with my problem while filling out form I-751... Totally accidentally I found out that Minnesota has a few districts, one of them is located where I live where representatives of Congressman help citizens to solve different federal matters and it is totally free. You do not need to spend money for lawyers or other advisers, but the person like the one who helped me has actually knowledge and direct contacts with people from different federal institutions and is able to get some information better and faster than normal citizens who will not find out much when calling USCIS call center... Check out if you have this kind of option in the state where you live!

We are currently having a HOMECOMING weekend. I mentioned about it in previous post. It is amazing! We have a lot of things going on in town even people in the bank were dressed in SMSU (my University) clothes. This University celebrates 50 years anniversary this year so it is a really big celebration.
